1. Who we are

This website is operated by Zach Nutter, a licensed real estate broker in Oregon (License #201219391) affiliated with eXp Realty LLC. References to "we," "us" or "our" mean Zach Nutter doing business as The Z-Man Real Estate Experience. You can reach us at zach@liveinpnw.com or 541-390-1695.

2. Information we collect

Information you give us:

Contact form submissions including name, email, phone number and message content. Email inquiries sent to our address. Any property preferences, timelines or budgets you share while working with us.

Information collected automatically:

Basic server logs from our hosting provider Vercel, including IP address, user agent, referring URL and timestamp. These logs are retained for a short period for security and reliability. If you consent to analytics, Google Analytics collects anonymised usage data such as pages viewed, approximate geographic region and device type.

We do not collect Social Security numbers, financial account numbers or government identification documents through this website.

3. How we use your information

We use your information to respond to real estate inquiries, send market updates or property information you requested, communicate about properties and services, comply with legal and regulatory obligations, and improve the website. We do not use your personal information for profiling or automated decision making.

4. Legal bases under GDPR

If you are in the European Economic Area or United Kingdom, we process your personal information based on one of these lawful grounds: your consent (analytics cookies, marketing emails), performance of a contract or steps to enter into one (responding to your inquiry), compliance with legal obligations (real estate record keeping), or our legitimate interests in running a safe and useful website.

5. Cookies and tracking

We use two categories of cookies and similar technologies.

Essential cookies keep the site working and are always on. They handle page navigation, secure browsing and basic session state. No personal profile is built from them.

Analytics cookies are off by default. If you click Accept all or toggle Analytics on in the cookie banner, we load Google Analytics with IP anonymisation, no advertising signals and no cross-site tracking. You can change your choice any time using the Manage preferences link in our footer or by clearing site data in your browser.

Embedded YouTube videos on our site use YouTube's Privacy Enhanced Mode (youtube-nocookie.com). No YouTube cookies are set until you click play on a video.

6. Who we share information with

We do not sell, rent or trade your personal information. We share information only with the following categories of recipients.

eXp Realty LLC, our sponsoring brokerage, as required by Oregon real estate regulations. Service providers that help us operate the website, including Vercel (hosting), Google (Places API for reviews and optional Analytics), and email providers we may use to respond to you. Each of these processors is bound by their own privacy commitments.

We also disclose information when required by law, court order or to protect the rights, property or safety of any person.

7. International data transfers

Our servers and service providers are based primarily in the United States. If you access this site from outside the United States, your information is transferred to and processed in the United States. Where required, we rely on Standard Contractual Clauses or equivalent safeguards to protect your information during these transfers.

8. How long we keep your information

Contact form messages and email correspondence are kept for up to 24 months after our last interaction, unless a longer period is required by law. Real estate transaction records are retained for the period required by the Oregon Real Estate Agency and the Internal Revenue Service, typically seven years. Server logs are kept for a short rolling window, usually under 30 days. Analytics data is retained for 14 months at most.

9. Your rights

Depending on where you live, you have some or all of these rights regarding your personal information: access, correction, deletion, portability, restriction of processing, objection to processing, and withdrawal of consent at any time.

EEA and UK residents have the full set of GDPR rights listed above. California residents have the rights granted by the California Consumer Privacy Act and California Privacy Rights Act, including the right to know, delete, correct and limit the use of sensitive personal information, plus the right to opt out of the sale or sharing of personal information. We do not sell or share your personal information as those terms are defined under California law.

Oregon residents have the rights granted by the Oregon Consumer Privacy Act, including the right to confirm whether we process your information, the right to access, correct, delete and obtain a copy of your information, and the right to opt out of targeted advertising, sale or profiling. We do not engage in any of those activities.

10. How to exercise your rights

Email zach@liveinpnw.com with the request. We will verify your identity using information we already have, respond within 30 days (or 45 days where permitted by law) and we will not charge you a fee unless your request is clearly excessive. You can also authorise an agent to submit a request on your behalf. If you are unhappy with our response, you have the right to lodge a complaint with your supervisory authority, such as the Oregon Department of Justice, the California Privacy Protection Agency or your local EEA or UK regulator.

11. Do Not Track and Global Privacy Control

We honour Global Privacy Control signals from your browser. If your browser sends a GPC signal, we treat it as an opt-out of any sale or sharing of personal information as defined by applicable law. We do not currently respond to Do Not Track headers because there is no common industry standard for them.

12. Data security

We take reasonable steps to protect your information. The site is served over HTTPS with modern TLS. Admin access to contact records is protected by authentication. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security.

13. Children

This site is not directed at children under 13 (or under 16 in the EEA and UK). We do not knowingly collect personal information from children. If you believe a child has provided us information, email us and we will delete it.

14. Oregon real estate disclosures

As a licensed real estate broker in Oregon (License #201219391), we comply with Oregon real estate regulations regarding client information, agency disclosures and record keeping. Transaction-related records are retained as required by the Oregon Real Estate Agency. Every buyer and seller we work with receives the required agency relationship disclosures separately from this policy.

15. Changes to this policy

We may update this policy. The effective date at the top of this page shows the current version. Material changes will be communicated on the site.
